Transferring data to new hard drive

Hi,

 

I am getting ready to transfer data on to my new hard drive from a failing one in my early 2008 macbook. I have a good clean copy of the drive on super duper. Do I need to have the operating system on the new hard drive before dragging and dropping the super duper clone on it? Running mountain lion 10.8.3

use Super Duper (or Carbon Copy Cloner) to put the old drive onto the new drive. if you copied the system during your initial backup it should boot on the new drive. you can test to see it if works by targeting the BACKUP drive in the Startup Disk control panel found in System Preferences.
